Parties
These Terms of Service (“Agreement” or “Terms”) constitute a legal agreement between Elera Yazılım ve Bilgi Teknolojileri Ltd. Şti. (hereinafter referred to as “Elera Yazılım,” “Company,” “we,” “us,” or “our”) and any individual or legal entity (hereinafter referred to as “User,” “Member,” or “you”) who visits, uses, registers for, or benefits from any service on qrcodeg.com and its associated subdomains (hereinafter referred to as “Site” or “Platform”).

Important Notice
Please read these Terms carefully. By using the Site, creating an account, or accessing any service, you acknowledge that you have read, understood, and agree to be bound by all provisions of this Agreement.
Age Restriction: The Platform is intended for users aged 18 and above. Individuals under 18 years of age are strictly prohibited from creating accounts or using our services.
1. Scope and Purpose of Agreement
1.1. This Agreement governs the use of all services provided by Elera Yazılım through the Platform (including but not limited to QR code generation, management, analytics, premium features, etc.) and establishes the mutual rights and obligations of the parties.
1.2. Services offered on the Platform include but are not limited to:
- Static and dynamic QR code generation
- QR code management dashboard
- QR code analytics and reporting
- Customizable QR code designs
- Bulk QR code generation
- API integration
- Premium features and add-ons
1.3. This Agreement applies to both individual users and representatives acting on behalf of organizations or companies.
1.4. Users accessing paid services are bound by these Terms from the date of account creation; users accessing free services are bound from the moment of first use.
2. Definitions
Platform/Site: The qrcodeg.com domain and all associated subdomains
Service: All paid and free QR code services offered through the Platform
User/Member: Any individual or legal entity using the Platform
Account: The membership registration created by User on the Platform
Content: Any data uploaded by User to the Platform, including text, images, documents, links, etc.
Premium Service: Advanced features requiring paid subscription
QR Code: All QR code images generated through the Platform
3. Account Creation and User Obligations
3.1. Account Creation
3.1.1. User acknowledges and warrants that all information provided during registration (name, email, phone, company information, etc.) is accurate, complete, and current.
3.1.2. Accounts created with misleading, false, or information belonging to others may be immediately suspended or deleted.
3.1.3. Only one account may be created per email address.
3.2. Account Security
3.2.1. User is responsible for securely maintaining account passwords and login credentials.
3.2.2. User bears full legal and financial responsibility for any unauthorized sharing of passwords, account transfers, or misuse.
3.2.3. In case of unauthorized account access, User must immediately notify Elera Yazılım.
3.3. Account Transfer and Sharing
3.3.1. Transfer, sale, rental, or unauthorized sharing of accounts with third parties is strictly prohibited.
3.3.2. Upon detection of such activity, Elera Yazılım reserves the right to immediately close the account without refund.
3.4. Corporate Accounts and Representation
3.4.1. Individuals creating accounts on behalf of companies or organizations represent and warrant that they have the authority to do so and have obtained necessary legal approvals.
3.4.2. The represented organization is responsible for all actions taken by its representatives.
4. User Content and Responsibilities
4.1. Content Responsibility
4.1.1. User acknowledges full legal, copyright, and privacy responsibility for all content uploaded to the Platform (text, images, documents, links, videos, etc.).
4.1.2. Elera Yazılım accepts no liability for User content.
4.2. Prohibited Content
User agrees not to upload the following content to the Platform:
- Personal health information or sensitive personal data (GDPR Article 9)
- Official documents, identity information, financial data
- Obscene, pornographic, or sexual content
- Racist, discriminatory, or hate speech
- Content promoting violence, terrorism, or illegal activities
- Copyright-infringing materials
- Viruses, malware, or malicious code
- Fraudulent, phishing, or spam content
- Gambling, illegal betting, or unlawful activities
4.2.1. Upon detection of such violations, Elera Yazılım may:
- Immediately remove the content
- Temporarily or permanently suspend the account
- Report to legal authorities
- Initiate legal proceedings
4.3. Content Publication
4.3.1. The Platform enables sharing of User-provided information with third parties through QR codes, with User consent.
4.3.2. User acknowledges that information shared via QR codes is publicly accessible and accepts this condition.
4.3.3. For dynamic QR codes, User may update or disable content at any time.
5. Service Terms
5.1. Service Scope
5.1.1. Elera Yazılım provides free and paid QR code services through the Platform.
5.1.2. Free services are offered with limited features and quotas.
5.1.3. Premium services include advanced features for a subscription fee.
5.2. Service Continuity
5.2.1. Elera Yazılım makes reasonable efforts to provide uninterrupted and error-free services.
5.2.2. However, temporary interruptions may occur due to maintenance, updates, infrastructure issues, cyber attacks, or force majeure events.
5.2.3. Scheduled maintenance will be announced in advance.
5.2.4. Elera Yazılım bears no liability or obligation for compensation due to service interruptions.
5.3. Service Modifications
5.3.1. Elera Yazılım reserves the right to, without prior notice:
- Modify service features
- Add new features or remove existing ones
- Update quotas and limits
- Change Platform interface
5.3.2. Users will be notified of significant changes via email or Platform notification.
5.4. Data Storage and Backup
5.4.1. Elera Yazılım stores User data on secure servers.
5.4.2. Despite regular backups, Users should maintain their own backups against potential data loss.
5.4.3. Elera Yazılım bears no responsibility for data loss due to technical failures, cyber attacks, or force majeure events.
6. Pricing and Payment Terms
6.1. Pricing
6.1.1. Service prices are displayed on the Platform and expressed in USD (United States Dollars) or local currency.
6.1.2. Elera Yazılım reserves the right to change prices without prior notice.
6.1.3. Price changes do not affect existing subscriptions; they apply only to new purchases.
6.1.4. Prices of items added to cart are not guaranteed until payment is completed.
6.2. Payment Methods
6.2.1. Payments can be made through methods specified on the Platform (credit card, bank transfer, etc.).
6.2.2. Payment processing is conducted through secure payment infrastructure providers.
6.2.3. Elera Yazılım does not store credit card information.
6.3. Subscription and Renewal
6.3.1. Paid services are offered on an annual subscription basis unless otherwise specified.
6.3.2. Subscriptions do not auto-renew; Users must manually renew.
6.3.3. Accounts without renewal become inactive after expiration, and content is suspended.
6.3.4. Suspended accounts can be reactivated if renewed within 90 days. After 90 days, data may be permanently deleted.
6.4. Invoicing and Documentation
6.4.1. Invoices can be requested after payment.
6.4.2. Billing information can be updated during or after payment through account settings.
6.4.3. Invoices are sent via email within 5 business days of payment.
7. Right of Withdrawal and Refund Policy
7.1. Right of Withdrawal
7.1.1. In accordance with applicable consumer protection laws, Users may withdraw from purchased services within 14 days.
7.1.2. However, once service usage begins (QR code creation, customization, etc.), the right of withdrawal is forfeited.
7.1.3. Personalized content and digital services are exempt from the right of withdrawal.
7.2. Refund Terms
7.2.1. Valid withdrawal requests will be refunded to the original payment method within 10 business days.
7.2.2. Discounts and promotional offers are non-refundable; only the amount paid is refunded.
7.2.3. Refunds may be requested for technical failures, service interruptions, or issues caused by Elera Yazılım.
7.3. Refund Requests

8. Intellectual Property Rights
8.1. Platform Intellectual Property
8.1.1. The Platform’s design, software, code, logo, trade name, and all content belong to Elera Yazılım.
8.1.2. No part of the Platform may be copied, reproduced, or distributed without Elera Yazılım’s written permission.
8.2. User Content Rights
8.2.1. User retains all rights to content uploaded to the Platform.
8.2.2. However, User grants Elera Yazılım a license to display, store, and use such content to provide the service.
8.3. QR Code Ownership
8.3.1. Visual files of generated QR codes belong to User.
8.3.2. User may freely use QR codes for commercial or personal purposes.
8.3.3. Elera Yazılım reserves all rights to QR code generation technology and infrastructure.
9. Privacy and Data Protection
9.1. For detailed information about processing, storage, and protection of personal data, please review our Privacy Policy and Cookie Policy.
9.2. User acknowledges having read and accepted these policies.
10. Account Suspension and Termination
10.1. Termination by User
10.1.1. User may close their account at any time.
10.1.2. Account closure can be performed through account settings or by emailing [email protected]
10.1.3. If account is closed during an active paid subscription, no refund will be provided for the remaining period.
10.2. Suspension or Termination by Elera Yazılım
10.2.1. Elera Yazılım may suspend or permanently close accounts in the following cases:
- Violation of these Terms
- Sharing illegal content
- Abuse, spam, or fraud
- Account creation with false information
- Non-payment
- Activities harmful to the Platform
10.2.2. In such cases, Elera Yazılım reserves the right to refuse refunds.
10.2.3. Account closure decisions are final and non-appealable.
10.3. Post-Termination
10.3.1. Upon account closure, all QR codes and data are deleted.
10.3.2. Some data may be retained for legal compliance purposes.
10.3.3. Closed accounts cannot be reopened with the same email address.
11. Limitation of Liability
11.1. Disclaimer of Warranties
11.1.1. Platform services are provided “as is.”
11.1.2. Elera Yazılım does not guarantee that services will be uninterrupted, error-free, or secure.
11.1.3. Free services are provided without any warranty, technical support, or continuity commitment.
11.2. Limitation of Liability
11.2.1. Elera Yazılım shall not be liable for indirect, incidental, or consequential damages arising from User’s use of the Platform.
11.2.2. Elera Yazılım’s total liability is limited to the amount paid by User in the last 12 months.
11.2.3. Elera Yazılım is exempt from liability in cases of force majeure (natural disasters, war, cyber attacks, government actions, etc.).
11.3. Third-Party Links
11.3.1. The Platform may contain links to third-party websites or services.
11.3.2. Elera Yazılım is not responsible for the content or privacy practices of these third-party sites.
12. Dispute Resolution and Governing Law
12.1. Governing Law
This Agreement is governed by and construed in accordance with the laws of the Republic of Turkey.
12.2. Jurisdiction
For disputes arising from this Agreement, the courts and enforcement offices of Istanbul (Çağlayan), Turkey, shall have exclusive jurisdiction.
12.3. Consumer Rights
Users qualifying as consumers under applicable law retain the right to pursue resolution through consumer arbitration boards and consumer courts in their jurisdiction.
13. Modifications to Terms
13.1. Elera Yazılım reserves the right to modify these Terms without prior notice.
13.2. Significant changes will be communicated to Users via email.
13.3. Continued use of the Platform after changes are published constitutes acceptance of the new terms.
13.4. The current version of these Terms is always accessible on the Platform.

15. Effective Date
These Terms become effective on the date User creates an account or begins using services, and are binding between User and Elera Yazılım.
